why not try battery replacement at apple first?

I don't believe they will charge you if it turns out the damage is other than the battery itself.

Apple is not responsible for the loss of information while servicing your iPhone and does not offer any data transfer service. Please do not send any accessories with your iPhone.

That's extremely irritating. I wouldn't accept it.

Since your phone is defective, I'm sure they'll make an accommodation for you. Just be insistent. Nice, but insistent. Keep talking until you get what you want - either a working 3G phone, or an upgrade for the upgrade price.

It's not OK for the phone to die while you're in the middle of your contract.

BTW, I'm assuming that you bought the iPhone at the AT&T store. If you bought it from Apple, take it into one of their stores and do the same thing - insistent but nice.
