At this point the main issue is whether the class action suit gets certified by the Court. If it does, then the action is against certain persons. The corporation, Allen Vanguard, is a "person" as defined under the Interpretations Act. Even if Allen Vanguard is bankrupt, the class action is against other named "persons". If the class action suit has any merit these other named person should be crapping their drawers, as their wealth is subject to an $80M lawsuit.
