the tax code also has regulations that prescribe how a mutual fund must treat a post-October capital loss or currency loss for purposes of determining its taxable income, its earnings and profits and the amount that it may designate as capital gain dividends for the tax year in which the loss is incurred and in the succeding year.
In other words, just like for an individual to get the tax loss in the right year you must sale by the end of the year, a mutual fund must sale the stock by the end of October (because the internal revenue code requires it)
