I know that the counting is not final, and the election result has not yet been certified by the local authorities.

Completely legal and proper under House rules insofar as the ONLY OPPONENT had FORMALLY CONCEDED the election.

(However... if the final election vote count results in the other guy being certified as the winner then the current serving NY-23 rep. would have to be ejected and the new guy sworn in!)

Mathematically possible still but highly unlikely. He would have to win more then 80% of the absentee votes (out of a three way field) to overcome his current vote deficit.
