American usage is a bit beyond just criminal penalties.

But not to a requirement that every organization be treated equally in terms of getting a government contract, esp. when the group isn't one that's protected by interpretations of the 14th amendment.

Apples and pineapples

No apples and apples, earmarking money to a particular group is the same as earmarking it away from every possible competitor group. Even if there was a prohibition against passing a bill saying "funding will not go to group X" (and there isn't), the bill could easily say "funding will go to groups a,b,c,d,e,f,...v,w,y,z.
