And if you do try them in a court they should still have their status as captured enemy combatants, if they are not convicted they should not be released (unless they are not convicted because of evidence that they are not enemy combatants), but once you get an acquittal I could see Obama's administration releasing them or if it doesn't some court ordering the release.

If your both a captured combatant your held for the duration if your a convicted criminal/war criminal your held for your sentence (or until your execution), if you're both your held for both, just the end of your sentence or the end of the war shouldn't cause a release until the other happens. (Well minor criminals might be pardoned at the end of the war, but people like KSM aren't minor criminals)
