Because the lawfulness of the military courts and combatant detention kept getting sent to court, with I believe no less than three US Supreme Court opinions.

I would have to assume with favorable rulings for the use of military courts, because they are still going to use them in the current administration.

Unlike his predecessor, and despite people claiming the opposite was true, GWB was more inclined to follow the law but didn't he get the go ahead from the SC to try these terrorists in a Military Court?
