The analogy of Sun to Apple and their respective lawsuits is flawed, as the reporter for ABC should know. In point of fact Apple did not own the basic technology it was suing Microsoft over. Xerox PARC researchers invented the GUI, and that is that, far as I know.

Sun is a lot more like Xerox this time around than Apple. They own the basic technology of Java.

Note that *both* Apple and Microsoft ended up paying Xerox, pretty much without a squack, too. After Xerox let them fight it out for years. Everybody else paid Xerox too, I think.

Just like Netscape and many others will pay for GIF format compression. And so on. When the truth is on your side, and you really did invent something, then people tend to sympathize, weasel wording notwithstanding. Not to say they can't stall in court for long enough to make the point near moot, possibly.
