You are correct on the effect on submarine patents. As I said, things are getting better, and that was one important step. But equally critical is the nonobvious clause. The courts & the USPTO have shown renewed interest in tightening that up. I hope they do.

You can protect yourself pretty well with patents, IF you do your prior art searches well. I do.
