No, it doesn't. But it takes an awful lot of twisting to decide we are at war with an organization. Granted, we talk about things like class war, war on poverty or drugs. But AFAIK there haven't been POWs, prisoner exchanges, peace treaties, etc. And in the wars on crime and drugs, those captured were tried in civilian courts...
