The "civil war" in Iraq meets this definition....

We are involved in a civil war in Afghanistan by actively supporting one side.

What other war are we a participant in???

And your reason for using military tribunals is not too different than lynch mob mentality, is it??? You really don't want a trial at all...so just say so.

The "civil war" in Iraq was a war over the same piece of ground, Iraq. So, it WAS a war between countries, Sunni Iraq and Shia Iraq.

The "war on terror" was just idiocy. Trying to prevent stateless terrorists from launching attacks by trying to take and hold certain pieces of ground when they have a dozen to choose from is a fools errand. History will judge it as such.
