Mr. Kugler,
Let me restate what I was getting at before. If the number of outstanding shares are all in NAME form and I request a certificate for shares sold to me, how is my broker going to get my certificate request filled?
1) Can my broker delay filling the request indefinitely?
2) Can the number of shares in certificate form exceed the
number of outstanding shares?
3) Can the number of shares in certificate form exceed the
number of shares in the public float?
4) Could restricted shares be used to fill certificate requests
exceeding the number of shares in the public float?
5) Is there a timeline that I have to have my request filled by my broker? If so what are the penalties for not meeting this requirement?
These questions are sincere. I have been asking these and other questions to my brokers, the old TA, the DTC. When it comes to the scenario that we are trying to play out here, all three of these entities don't seem to have solid answers. I don't believe this has occurred before and it is confusing to all.
