I agree with Blue, employers should pay for performance and not whether they can detect that you have done something off hours. Absent too much, forget to sign the sales agreement, fine. If someone were to get a DWI, they probably wouldn't be fired unless their job involved driving, but smoke a joint at home (a lesser crime with no likely victim) and they can?

I believe corporate drug testing constitutes a fascist de facto double jeopardy risk. Because the tests are looking at long half-life metabolic residue, they can, in theory, cause multiple legal problems (for up to 21 days) for a single minor infraction of the law. You could smoke a joint day 1, at home, be stopped and tested on day 3, day 4, day 5, etc. and even though you were never actually high at the time you were tested, nor did you subsequently partake, you'd test positive on multiple measurements. You could have your license taken on day 7 and fired on day 10.

Opiates clear in a few hours. You could shoot up on Saturday and be clean on Monday. It's crazy.
