Granted. I meant legally. It would be stupid to flaunt it but no one should be penalized for taking their medication especially if it didn't affect performance and the ONLY way anyone knew was with an invasive test.

I don't want people impaired when flying a plane, whether it is because they had an all-nighter with a flock of air hostesses or simply because they have a tumor in their head.

For pilots, I think a biometrics performance test 20 minutes before the flight should be sufficient. Reflexes and reasoning sluggish? Don't take off. I don't care what the reason is. Divorce. Booze. Pot. Inadequate sleep. The more we learn the more we know that impairment is impairment and chemical impairment is only one kind. A guy with a migraine is as much of a risk as someone stoned.
