The idea of "consent of the governed" isn't really relevant, and in fact isn't really a reality.

It's relevant as a justification, and in fact it is a reality under our constitution.

Now if you want to throw out the constitution... we could go to anarchy. All the "personal freedom" you could ever ask for.
