The people are not primarily a collective. Anyone who doesn't consent, isn't consenting.

Not really a new dimension, rather one that had already been raised. Whether something is an attack, a justified attack, defense, or somehow correctly imposing "the consent of the people" is partially a moral question.

Not at all. The constitution doesn't address this issue.
