IMO, if you have a law, it should be enforced. If you're not willing to put the resources into enforcing it, then it shouldn't be against the law. Not enforcing laws breeds disrespect for the law. It also breeds bad laws.

However, I'm not king of the world. Reality is something entirely different from my preference. Enforcement is specified with a wink. Potential penalties are there for reasons other than setting the penalty. It gives the police leverage. You seem to be coming from an world where enforcement is rigid. That's not the squishy world I know.
