Mohan, Under a breach of contract claim, one could, I suppose, argue that there is an implied promise on the part of the broker to provide adequate personnel and technology to ensure adequate service. This might be adequate in the absence of a specific disclaimer to the contrary. The really hard part would be damage calculation and proof of damages certain caused by their alleged inadequate telecom service. Good luck with walking over to Waterhouse.
