Well if you watched the PBS frontline you will see that the Commissioner stepped in to regulate all derivatives. This create a furor and earned her a lot of enemies fast. She declared, under law, that her commission had the authority to regulate dervivatives of all types. Congress changed the law so that she couldn't regulated derivatives. This is still true today.
