You don't get anything even close to 40 MBPS downstream OR 10 MBPS upstream--EVER!!!! This is exactly what I mean about consumers being suckered into the bullshit claims and specs. The provider's connection is still the limit on the host side for cache misses, and 10baseT is the limitation on the client side. Even if the channel were CAPABLE of 1GBPS, I bet you'd never see a difference between that and 1MBPS--you just THINK you need those data rates in the tens of megabits. At 1MBPS, many potential technologies exist to satisfy those bandwidth requirements. Static HTML pages, or pages with cheesey motion-graphics viewports don't require bandwidths much greater than a couple hundred kbps in order to appear instantaneous. Don't kid yourself into believing that a similar Quality of Service for internet access can't be matched by any other existing technology. Other applications that do require higher bandwidths are a different story, but internet access isn't (in general) one of them.
