No, it isn't. Bush policy was not to bring SOME these people to NYC and put them on trial -- depending, essentially, on whether he thought a conviction could be obtained. By the end of his terms Bush had established a sensible way of handling them, Obama tried to rescind it, and has created a fractured, insane policy.

Essentially, the policy under Obama is as follows:

a) If we're pretty sure we can get a conviction, put in criminal courts--if there is a surprise acquittal, we'll keep them in jail anyway;

b) If we're not sure about the conviction in criminal courts, we'll consider trying them in a military tribunal, if we're sure we can convict;

c) If we're not sure we can convict in a military tribunal, we'll just detain them indefinitely.

This is the most UN-AMERICAN process one can imagine. It is inconsistent and incompetent.

Here is the fundamental problem: There are two established processes under which these people can be tried -- criminal courts and tribunals. Both of these processes respect these individual's rights fully and are totally legitimate, MORAL and legal.

Obama's insane policy basically is to suggest that military tribunals are somehow inferior to the criminal courts, when the simple truth is it is a matter of picking the CORRECT tool for a given job.

And the result is that he discredits the very military courts he plans to use for those people he can't convict otherwise.

It is a policy that only an incompetent could rationalize.
