I actually think it is probably a pretty reasonable extension of existing case law from the Supreme Court on pen registers. You have no reasonable expectation of privacy in the data collected by the telephone company when you dial a phone number because, well, you know the phone company is sent this data to route the call and is collected for, among other things, your billing. Same thing with GPS data communicated through the phone company. I think the GPS data collected at the phone company is reasonably discoverable by law enforcement for the same reason.
