Your probably right, however if this is done thru a Cayman Corp, the US has no control or taxation. (that is of course unless they trot back over here and put it on the IRS filings? :)

I imagine Cayman are US citizens. I think the SEC termed them 'aggressive' investors, meaning their (1995??) actively shorting offshore during the holding period on Reg S stock was outside the intent of the SEC regulations.

Clearly, tax evasion is a crime. No one should evade their taxes--"render unto Caesar what is Caesar's..." Unfortunately I cannot absolutely rule out Cayman not crossing that line-but I can hope not. It could be their tax period is not calendar. I don't know. Many possibilities, little verifiable unless disclosed.
