Since Stack is an American, and wasn't under the influence of a foreign country or group of individuals plotting the killing of Americans, he can be a domestic terrorist, or criminal. Either way, he will and should be tried, in the American Court System.

If he did what he did, and was influenced for a foreign jihad group as described as above, then he should be tried in a Military Court. What he did then would be an act of war.

At least that's what my common sense tells me, not being a lawyer.
