There is a presumption in favor of a laws constitutionality.

There is no such presumption (it was talked about, but not included in the constitution), at least not for laws by the federal government. The federal government has constitutionally limited powers. If it can not be shown how a proposed law fits within those powers than the law is unconstitutional (even if it doesn't always get judicially recognized as such).
