You are aware of the abuse in the private insurance market... even with all the regulation? Imagine an unregulated or very low regulated market. It might easily have less abuse. Even with the regulation the main check on abuse is still competitive pressures, not the regulation itself. With less regulation the competitive pressures would likely be more extensive. And with less regulation, more attention could be paid by the regulators, courts, etc. to actual scam artists, and less to all sorts of technical requirements of dubious utility.
