Fee for service would work really well for cost containment, if the patient was paying the bill mostly out of pocket, but that is less and less often the case.

It would work even if an insurance company was paying.... if the provider gets a flat fee he's going to figure a way to cut (hopefully meaningless) costs no matter who is paying him.

How do you legislate away pay for service? I can't think of a way to do it. Outside of single payer... and that's off the table.
