I heard an interview on NPR yesterday with the show creator. He said they were planning on killing Jesse off as the finale to season one, but they liked the character the guy had acted so much, they decided to keep him.

As to Walt's brother being DEA, I predict he can turn that frown around by claiming foreknowledge of raids. Of course, then he'll have to deliver, which will have him pumping his suspicious bro-in-law..
