PCS, auctions are perfectly legal in the USA. What's illegal is fraud. The contract simply says, "Buy this phone and you can bid for megabytes. The current bid is $0 per megabyte. Click HERE to see previous prices people have paid for megabytes. If you later don't want the phone, sell it on this phone trading website - click HERE to sell your phone. If you can't understand this, you are not authorized to use the Globalstar service. Go and buy the expensive Iridium service or drive your car to town to talk to the people you want to contact".

There is no bait and switch.

The ignorant FCC would say "But that isn't a traditional price plan. You didn't even mention arpu. We can't approve that." There is obviously a need to ditch the dopey price plan approvals process and those involved should get real jobs more suited to their talents [with more realistic salaries]. Rumour has it that the USA is running low on money to pay the hordes of government spivs. There's a way to save some money. There must be a whole bunch of people sitting around approving price plans who can be given jobs as Wal-Mart greeters or road sweepers if they are not able to welcome people.
