It is the position of the Defendants that the SEC departed from the proper administration of criminal justice in procuring the Defendants testimony under oath, and by not warning Defendant Harris, of his constitutional rights and protections before questioning him. Federal courts have supervisory authority over the manner in which Federal agents exercise their power. Rea v. United States, 350 U.S. 214, 217 (1956); United States v. Scrushy, 366 F. Supp. 2d 1134 (N.D. Ala, 2005); United States v. Parrot, 248 F. Supp. 196, 199 (D.D.C. 1965).

Defendants concede that they were not in custody when deposed by attorneys from the SEC and not entitled to Miranda warnings on that basis.
