Indeed, but that doesn't speak to enforcement shortfall. Enforcement isn't just for regulatory agencies.

I read the other day--don't know if it's so--that the law doesn't contain a mechanism to enforce the insurance mandate, either. Enforcement is typically a stepchild. More so when you're trying to get your legislation under budget. Most enforcement comes where the law is about violence and where the cost of enforcement can be recouped.

[I worked the enforcement reorganization that was the centerpiece of the Clinton administration's EPA. Had the agency upended for the first couple of years. Hard to say if it did any good. By the time you can measure those things, the interested parties are already out the door. And each new administration has it's own wheel to re-invent.]
