"That not buying something is not commerce, and that in state actions are not "interstate".

The health care system is so interconnected across state lines (using products manufactured elsewhere) that the "in state" argument will probably not stand up.

Most of legal community is making the argument that the "buying" will be treated as a "taxing power" of the Federal government--which has been constitutionally affirmed and the individual doesn't get to opt out of a tax.

But we will certainly soon find out with the bringing of the suits by the states AG's.
