They could write a program to kick out all those who filed income tax and haven't offered proof of insurance, assess a penalty to them, and deduct it from their refund if they're getting a refund.

Your team, unless it's a team of magicians, couldn't identify anyone who didn't file a tax return, validate the claims of insurance, collect the penalty if there was not enough of a refund to cover it, or prosecute anyone.


It will start out just as you say. But then there will be regulations requiring every health insurer to submit form 1098-HI to every insured by Jan 31 of every year, THEN a copy on mag media to IRS. And they'll match them up.

If a taxpayer happens to overlook the 1098-HI, he will be assessed a penalty, interest, and a Negligence penalty for having overlooked it.

And a new government bureaucracy is born which allows the federal government to assure itself that we all have our current insurance cards.

Really pathetic when you think about it.

God, I hope the Supreme Court has the moxy to solve this problem.
