I had this discussion with some classmates in law school during the transfat thing. The liberal argument is that some things make us unhealthy, which ends up being a drag on the public treasury due to increased Medicaid/Medicare and other public payments for health care costs, so our unhealthy choices become a drag on the public and the public has an interest in regulating those unhealthy choices.

My response: then cut the Gordian knot and get government out of health care. The problem of our "unhealthy choices" affecting the public treasury then disappears. Problem solved. They looked at me like I just told them I sleep with my mother.
