no evidence to suggest that the process in any way compromised the safety of Americans. It establishes a legal precedent, though an argument could be made that the precedent should apply only to persons accused of attacks that have been carried out on American soil.

If you're going to argue that foreign citizens accused of terrorist acts or conspiracy aren't entitled to the due process of civilian trials, then I don't see how giving them military trials makes much difference. There is due process involved in either case.


On the no evidence that the process mattered....it is hard to know. A second attack did happen on the same target. Perhaps it would have happened no matter what.

The legal precedent part - could also argue that that WHO is being attacked plays a role. Are civilians being attacked or are military targets being attacked? In addition to obvious military facilities overseas, I would consider the Pentagon a military target.

On due process - it seems as if the due process that both GWB and now Obama have agreed on is the due process of a hellfire missile. The idea that it is okay to execute a terrorist with a missile but IF they are captured, they are due a civilian trial seems silly to me. We shoot hellfire missiles at threats to the USA that are worthy of being attacked by the military. Obviously only certain human targets are worthy of being attacked with hellfire missiles - those are the guys that do not deserve civilian trials, IMO.
