Well actually you can only pardon somebody that has been convicted however I would expect the charges to simply be dropped and they guy would just be assigned a duty station somewhere stateside and that would be the end of it.

I doubt he would pardon the guy, and he could refuse the pardon and demand the evidence or prove him guilty...
