why and how has this lawsuit come about, and why now?

The lawsuit coincides with the administrations introduction of the first attempt at financial reforms since the economic implosion during the Bush Administration.

They hope to channel public outrage into support for regulatory change.

Of course the Republicans are unanimous in rejecting anything that would impair the freedom of their supporters to send millions into their re-election campaigns, hence any mention of derivatives constraints will cause banshee-esque screeches.
