I suspect there were lots of negotiations before this action was brought. These emails weren't produced voluntarily. Moreover, SEC probably gave Goldie the opportunity to settle when presented with information in the complaint. That's pretty standard stuff. And unless SEC was running up against a statute of limitations, GS wouldn't likely have known when SEC was going to file the complaint.
