As far as I could tell (after reading the linked message in your post) the issue of stratosphere vs. troposhere was not a key to the legal and factual issue before the court--the factual issue was: Was CO2 harmful in a global warming sense.

Are you saying you have to be a scientist to understand that issue? And if so, I have to say it's not the judges job to play scientist--they have to go by the evidentiary record in front of them. What side has the more weight.
