Well I think if you look at how the SC and government first lined up on one approach to segregation and then completly turned that approach around when they saw it was out of joint with the times, that might resolve the differences between Ed and you on the SC actions vs. the meaning of the Amendments.

Over time the position(s) is/are adjusted, or Amendments to the Constitution are made.
