The government must speak for those who cannot speak for themselves, and stand up for those who cannot stand up for themselves, especially when they don’t have mouths or feet.”

Nonsense. The only reasons I see for creating another such regulatory layer are to gain control from the top by eliminating more government agencies' self-control, and to insulate Obama.
