Justice Brandeis in the 30's shut down Roosevelt's use of the commerce clause to drive support for the National Recovery Administration. He decided in favor of the Schecter's Kosher Chicken slaughters and against the NRA's attempts to regulate this industry by saying chicken slaughtering is not interstate commerce. Then pulled aside the NRA leaders and told them to get out of washington and back to the states - much against Felix Frankfurter. I think it was after this that Roosevelt tried to stack the court.

Looks like this is just same old same old. It is amazing how much this is a repeat of Roosevelt's power grab in the New Deal.
