I know the regulatory system for telephony is ridiculous. To explain further, the old Bell System would file a Rate Case when the service deterioriated and the PSC could no longer hold back rate increases. Then the Engineers would start the rate case process stating what equipment they would buy. They would buy the best equipment they could buy and as many spare parts as possible in return for guarantees of service improvement.

Crazy, but the Bell System worked for many years.
