Except that without the estate tax law of previous years there is no step up basis, DOD or 6 months.

If the cap gains tax then kicks in on an estate the basis would have to be the cost to the deceased? Then there is the gift tax exemption of $1M. Seminole83-akaTravisBickle does this for a living. Maybe he will pipe in.

Someone told me that to reinstate the estate tax for 2010 Congress would have to repeal all of Bush's tax act. I'm not sure about that.
