When there is war on, international waters are part of the war zone. The General Belgrano was sunk in international waters and a good thing too.

When invaders invade as the blockade busters were doing, it's an act of war. Their intentions were clear so there was no need to wait until they berthed. As soon as the Israelis landed to inspect the ships, they were attacked with murderous action.
