What I said sir is that when I invest in a stock I know whether it is due a dividend or not, and were I to find a stock dividend in my account that should not be there I would not sell it but would first inquire as to why it was there. If I received assurances that it was indeed mine then and only then would I sell it.

If the bank screws up and puts $10K in your account should you spend it. Do you think the judge is going to believe you when you tell him you thought it was yours.

I don't beleive Jack when he claims he is innocent of any errors in his matter. While I don't beleive he was innocent I think Datek was at best stupid in their handling of the matter. Datek certainly complicated a minor problem into a much larger problem. It is my hope that they have learned from that mistake.

As for claims that I think if a person isn't intellegent enough (where did that come from) he doesn't have a right to his money. I don't think I said anything like that. What I said is if people aren't grown up enough to be responsible for their own actions and need their hand held in investing they need a full service broker.

Wang, you are correct, they actually told me I had a dividend. I had no reason to doubt this. I trusted them. When my position including the dividend was going down, I was forced to close it. It turns out that Datek made a mistake. I did not know this till 4 days later. They snuck in a correction by putting me short without informing me. They later told me that they actually knew of the problem the very next day, but didn't tell me! Evidently, they had time to discuss the matter and got direction from their management to sneak in the transaction. They are a very devious bunch of people. In the end they actually made a profit off of this mistake. They basically stole the money from me. Notice the post that Rodney was Kind enough to re-post. They did nothing to minimize the damage, but instead froze my account and let the short position keep running against me till I pleaded on this thread for them to contact me.

I would not put it past them to be using Rodney on this thread. Of course, Rodnney and they will deny this. If you take the time to read Rodney's posts you will see how inacurate and twisted they are.
