I just got off the phone with the DEC.

The person I talked to has been out to the JBI site once.

The letter to do testing was confirmed. The 30 days is considered to be 30 operational days. It's purpose is to allow JBI to further characterize the operations process and the emissions created under a variety of conditions.

The process being used to obtain air permits is an iterative process. Meaning that JBII is doing testing and measurements of emissions from both the stack and any other points of emission that may be discovered during testing.

That data will be furnished to DEC for evaluation. Based upon what is found during the testing the specific details of the permit process will be worked out.

JBI has engaged a local company to assist with the testing to make sure that the testing is done in compliance with the appropriate testing protocols. The company selected is one that DEC has worked with before and is considered to be a reputable company.

We discussed several different scenarios of differing levels of complexity. The bottom line is... we will know more later.

Later is determined by when the company submits its initial stack test data and other data on emissions points. Stack testing will be done by the company JBI has hired. DEC may choose to come witness stack testing or may not depending upon what the initial data submissions show. DEC is also interested in having data that shows what emissions process has with differing input streams.

As an aside, the NY legislature hasn't passed this years budget and DEC has been put on alert that it may be forced to shut down on the 15th if a budget is not passed.
