By all accounts, he will either make a demand for an escrow account or announce that one has been set up.

Pure Kabuki.

The devil is in the details, however. BP has to set aside money for claims, anyway. If it is allowed to have a significant say-so in how the moolah is spent, BP should have no objection. On the other hand, if it discretionary spending at the whim of some governmental agency, I would be inclined to tell O! to stuff it if I were BP.

There is no legal basis I can think of for forcing BP to do this. Lots of political ways, however.

I don't like it.

I suppose O! has figured out that if BP bitches and refuses, he has an enemy to castigate and can turn up the heat on BP in a wag-the-dog kind of way. If it complies, he wins.

It is a win/win politically for him. And that is all he cares about. It won't make the clean-up or the plugging of the well go any faster. In fact, it might make the claims payment go slower as a we all know - especially down here - how federal agencies can delay.

Can you imagine FEMA in charge of an escrow fund?
