First, it will be interesting to see/hear the tone of Obama's speech tonight. If he speaks as POTUS and focuses on the problem at hand it is likely BP will rally. If he speaks like a primary candidate trying to hold the left half of the left half - it could get ugly. It is a unique opportunity to show leadership. I cannot believe he has not had enough coaching to know he should at least act like POTUS.

Second, I suspect BP could take BP America into BK. This would expose all the US assets to claims but shield the non US assets. Perhaps this is BP's biggest card in the came. There is a least one lawyer here (Carranza2). If he or any other person knowledgeable in corporate law could comment on this it might be illuminating.

Given the speech tonight - buying BP today remains like playing black or red on a table at Rama.
