BP's liability isn't all that limited here. They have already agreed to fund a $20bil escrow fund, and pay more if needed. Even without any agreement from them, they would likely be liable for billions, not $75mil. The $75mil cap is a very leaky cap. It doesn't apply at all in certain situations, doesn't apply if regulations are violated, doesn't cover every type of suit, and doesn't cover expenses for cleanup costs.
